This policy explains what data Fitness Business Développement collects on this website, why, how long it is kept and how to exercise your rights, in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act.
Data controller
Fitness Business Développement, SAS, 58 route de la Reine, 92100 Boulogne-Billancourt, France, RCS Nanterre 891 854 051. Contact for any question about your data: contact@fitness-business.fr.
Data collected
The information you enter in our forms: full name, business email and phone, company and position, information about your project (profile, type of deal, timeframe, location, floor area, revenue range, budget, available equity, operating experience) and your message, plus the technical data our host records with each submission (IP address, browser, referring page). We collect no sensitive data.
Please do not send confidential information about your business through the form: it is exchanged once a confidentiality agreement is signed.
Valuation simulator (“Value my club” page): your answers given in ranges (type of business, revenue, profitability, revenue trend, lease length, owner’s role, département, sale timeframe), your first and last name, your business email and your phone number, as well as the estimate shown. No exact amount is requested.
“Refer a project” form: we receive the business contact details of the person making the referral and a description of the project; the name of the person concerned is not requested. That person’s details are only passed on to us with their consent; we tell them where their details came from when we first contact them.
Purposes and legal bases
- Answering your request and preparing a possible assignment: pre-contractual steps taken at your request (GDPR article 6.1.b).
- Sending you opportunities matching your project, if you asked for it: your consent (article 6.1.a), which you can withdraw at any time.
- Calculating and sending you your estimate (valuation simulator), then contacting you about your project: your consent (article 6.1.a), given by ticking the box in the simulator, which you can withdraw at any time.
- Handling referrals and preparing the referral agreement: pre-contractual steps for the person making the referral (article 6.1.b); our legitimate interest for information about the project and the person concerned (article 6.1.f).
- Managing the business relationship and protecting the site against abusive submissions: our legitimate interest (article 6.1.f).
Recipients
Your data is only accessible to authorised members of the Fitness Business Développement team. It is never sold or transferred. It is only shared with a partner (lawyer, accountant, bank) with your consent, as part of an assignment.
Technical providers acting on our behalf:
- OVH SAS (OVHcloud), a French company: website hosting and form transmission, within the European Union.
- Rackspace Technology, whose mailboxes are provided to us by Netty, which receives form notifications.
- monday.com Ltd. (Israel), publisher of our request-tracking software, which receives sale and acquisition requests sent through our forms and the valuation simulator.
- Netty (Septeo group, France), publisher of our transaction software, in which our contacts are recorded.
- Brevo (Sendinblue SAS, France), which sends the email containing your estimate.
Transfers outside the European Union
Some of these providers are established, or host data, outside the European Union:
- monday.com Ltd. is established in Israel, a country recognised by the European Commission as providing an adequate level of protection (Decision 2011/61/EU of 31 January 2011). Our account data is hosted in the European Union (monday.com’s EU data region); some of it may be processed in the United States: these transfers rely on the European Commission’s standard contractual clauses.
- Rackspace Technology may process the emails received in the United States: this transfer relies on the European Commission’s standard contractual clauses.
You can obtain a copy of these safeguards by writing to contact@fitness-business.fr.
Company search
To identify your company, the “Company” field queries the Recherche d’entreprises API, a French government public service (Interministerial Digital Directorate). At the time of the search, it receives the text typed in this field and the technical information sent with any connection to a website (IP address, browser).
Retention periods
- Requests not followed up, including those made through the valuation simulator: 3 years from the last contact.
- Information about a referred project that is not followed up: deleted as soon as it is clear the introduction will not take place.
- Clients: for the duration of the relationship, then 5 years from its end for identification documents and transaction records, under anti-money-laundering rules (French Monetary and Financial Code, articles L561-2 and L561-12); accounting records are kept for 10 years.
- Opportunity alerts: until you unsubscribe, or 3 years without any exchange from you.
Your rights
You have the right to access, rectify, erase, restrict, object to and port your data, to withdraw your consent and to set instructions for your data after your death. To exercise them, write to contact@fitness-business.fr; we reply within one month. You may also lodge a complaint with the French data protection authority, the CNIL (www.cnil.fr).
